Terms of Service
Last updated: November 1, 2026
These Terms of Service (“Terms”) apply to your use of the daVinci website https://davinci-v2.gallery and its services (the “Service”), run by the daVinci community and DAO (“daVinci”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
- The Service
- Eligibility
- Your wallet
You use the Service with your own crypto wallet, such as MetaMask. You sign in by signing a free message in your wallet; this is not a transaction.
You alone control your wallet. We never have your private keys or recovery phrase and cannot recover them, reverse transactions or restore lost funds or NFTs. Nobody from daVinci will ever ask you for your recovery phrase.
Blockchain transactions are final. Check every transaction in your wallet before you confirm it.
- Creating NFTs
You may only mint works that you created or have the rights to publish. You keep the copyright of your works. By publishing a work on the Service you give daVinci a worldwide, non-exclusive, royalty-free licence to display, store and promote it on and for the Service.
Minting costs a minting fee per copy plus the network fee (gas). Both are shown before you confirm.
The name, description, number of copies and royalty of an NFT are written to the blockchain or IPFS when it is minted and can generally not be changed afterwards. Files on IPFS are public and permanent.
Daily mint limits apply. They depend on your status (unverified, Verified, Golden Artist) as described on the Create page.
- Buying and selling
Fixed-price sales. A seller lists an NFT at a price in the network’s currency (ETH on Ethereum, SHM on Shardeum). The buyer pays through the marketplace contract, which sends the NFT to the buyer and the payment to the seller in the same transaction.
Fees. The marketplace charges a fee on each sale, paid from the sale price. Royalties set by the creator are paid to the creator on secondary sales, as far as the contract used supports them.
Network fees (gas) are paid to the blockchain, not to daVinci, and are not refundable, even if a transaction fails.
Prices shown in USD are estimates only.
- Auctions
Auctions run on the daVinci auction contract. While an auction runs, the NFT is held by the contract and cannot be sold or sent elsewhere.
An auction lasts from 1 hour to 30 days. Each bid must be at least 5% higher than the previous one. A bid in the last 10 minutes extends the auction by 10 minutes.
Your bid is held by the contract. When someone outbids you, your bid is sent back to your wallet automatically; if that is not possible, you can withdraw it on the NFT page.
The seller can set a reserve price. If the highest bid is below it, or there are no bids, the NFT goes back to the seller and the bid is refunded.
After the end, anyone can settle the auction with one transaction: the NFT goes to the winner and the seller is paid, minus the auction fee and any royalty. Until someone settles, the NFT and the money stay safely in the contract.
The auction fee is fixed when the auction starts and cannot be raised for a running auction. A seller can cancel an auction only before the first bid.
- VINCI, badges and galleries
VINCI is the daVinci community token on Ethereum. Holding VINCI gives access to features such as the Verified and Golden Artist badges, which are checked daily from your public wallet balance.
VINCI is not an investment, share or promise of profit, and daVinci does not guarantee its price, liquidity or value.
Golden Artists can book exhibitions in our galleries and pay in VINCI. A booking is confirmed once the payment transaction is confirmed on the blockchain. If something goes wrong with a booking, contact us and we will look at it case by case.
- AI Video Studio
The Video Studio turns an image into a short video using an AI provider. Videos are paid with VINCI Credits: 1 credit = 1 video, and a video that fails gives the credit back. VINCI Credits are not a token, cannot be transferred or exchanged for money, and can only be used in the Studio.
You may only use images you have the rights to. Real people may only be published as characters by the person shown, after review. Harmful content is blocked.
Your images and videos are private until you publish them. Published videos can be seen and shared by anyone.
- Rules of conduct
- mint, list or sell works that infringe someone else’s copyright, trademark or other rights, or counterfeit items;

daVinci is a creator-first marketplace where artists mint NFTs (non-fungible tokens) and collectors buy, sell and bid on them. NFTs on daVinci live on public blockchains: Ethereum and Shardeum. NFTs created on the Harmony network are kept as an archive after Harmony was sunset in 2026: they can be viewed, but no longer sold, resold or sent there. Their holders can bring them to Ethereum with the migration tool.
daVinci is a platform and software interface. We are not a broker, bank, exchange or custodian, and we are not a party to the sales between users. All sales, bids and transfers are carried out by smart contracts on the blockchain.
You must be at least 18 years old and able to enter into a binding agreement. You may not use the Service where it is illegal for you to do so.
You agree not to:
Adult content is allowed only when marked as such; it is shown in its own private gallery. We may hide or remove any NFT, collection, comment or profile that breaks these Terms, and suspend accounts, especially of repeat infringers. We cannot delete or move NFTs on the blockchain, but we can stop showing them on daVinci.
If you believe that a work on daVinci infringes your rights, write to davincidao@gmail.com with: the work that is infringed, a link to the NFT on daVinci, proof that you own the rights or act for the owner, and your contact details. You can also use the “Report Token” button on each NFT page.
You understand and accept that:
The Service is provided “as is” and “as available”. We do not guarantee that it will always be available, error-free or secure, and we make no claims about the authenticity, legitimacy or value of the NFTs listed by users. Badges such as “Verified” describe a user’s VINCI balance and profile, not the authenticity of a work. Please do your own research before you buy.
To the extent permitted by law, daVinci is not liable for indirect or consequential damages, lost profits or lost data, or for losses caused by your wallet, blockchains, smart contracts, third-party services or other users. Our total liability is limited to the fees daVinci received from the transaction the claim is about. Nothing in these Terms limits liability for intent or gross negligence, for injury to life, body or health, or any other liability that cannot be limited by law. Mandatory consumer protection rules of your country of residence remain unaffected.
We may change the Service or these Terms at any time. The date at the top shows the latest version, and important changes will be announced on the Service. By continuing to use the Service you accept the updated Terms. We may suspend or end your access if you break these Terms. Your NFTs remain in your wallet on the blockchain in any case.
How we handle your information is explained in our Privacy Policy.
